Defendant, Richard J. Mossmann, appeals the judgment of conviction entered on a jury verdict finding him guilty of violation of custody. We reverse and remand for a new trial.

In April 1995, the defendant's ex-wife was granted sole legal custody of their daughter. Defendant was permitted only supervised visitation with his daughter. On May 23, 1997, when the daughter was ten years old, defendant took her from her home. In July 1997...
