Defendant, Jerry Emmett Olivier, was charged by bill of information with third offense driving while intoxicated (DWI), a violation of La. R.S. 14:98. After trial by jury, defendant was found guilty as charged. The trial court sentenced defendant to imprisonment at hard labor for five years without benefit of parole, probation or suspension of sentence. Defendant has appealed, urging in a single assignment of error that the evidence is insufficient...
