The matter before us is our certiorari review of a decision by the Court of Criminal Appeals affirming a decision by the trial court denying the defendant-petitioner's Rule 32, Ala. R.Crim. P., petition challenging his conviction for capital murder under § 13A-5-40(a)(4), Ala.Code 1975, and his convictions for other simultaneous crimes. Before the petitioner filed the instant Rule 32 petition, he had already appealed his capital murder conviction...
