WATHEN, C.J.

[¶ 1] The State appeals1 from an order of the Superior Court (Hancock County, Mead, J.) suppressing statements made by defendant. The court declined to find, beyond a reasonable doubt, that the statements were voluntary. The court's ruling was based solely on defendant's mental state and not on any improper police activity. Finding no error, we affirm.
