The defendant, The Department of Revenue for the State of Louisiana (Department), appeals the trial court judgment which granted summary judgment in favor of the plaintiff, The Shaw Group, Inc. (Shaw) That judgment abated the Department's tax assessment against Shaw and ordered the Department to refund the amounts paid under protest. There are two issues before the court for review: Whether a use tax was properly imposed on the two airplanes purchased...
