Harlon Anthony Ward ("Ward"), as father of Anthony Keith Ward, a deceased minor, sued Morgan County and Shelby Contracting Company, Inc. He filed the action pursuant to § 6-5-391, Ala.Code 1975, which allows an action based on the wrongful death of a minor.
