[¶ 1] Plaintiff York Mutual Insurance Company appeals from the judgment of the Superior Court (Penobscot County, Mead, J.) denying its claim for rescission of an insurance contract on the basis of misrepresentation in the application. York Mutual argues that the court misconstrued the requirement that the misrepresentation be material pursuant to 24-A M.R.S.A. § 2411 (1990). We agree and we vacate...
