¶ 1. This appeal arises from a civil action for malicious prosecution. Steve Hammack was charged in the County Court of Lowndes County with the rape of Angela Czaja, a/k/a Angela Barlett (hereinafter "Angela"). The incident occurred on July 23, 1989. Angela did not pursue the charge of rape, and it was dismissed on September 11, 1989 prior to the preliminary hearing. Hammack was then indicted for sexual battery after Angela testified before...
