Thomas Michael Johnson appeals from a dismissal of his action against Citizens Bank, Inc., and its employee Gracie Vickery. In his complaint, he alleged claims of negligence and fraudulent misrepresentation. The trial court entered the judgment of dismissal as a sanction under Rule 37, Ala. R. Civ. P.
