Uccello Immobilien, GMBH ("Defendant"), seeks to reverse a liquidated damages award ordered pursuant to a settlement agreement with Edward Resnick ("Plaintiff"),1 and to reverse the denial of a motion to extend the time of performance. Because the liquidated damages award was punitive, and because the district court did not abuse its discretion in denying the motion to extend time of performance, we vacate in part and affirm...
