Opinion by Justice GRANT.

Steven Howell appeals from the dismissal of his lawsuit against the Texas Department of Criminal Justice-Institutional Division, et al. He alleged in his petition that he slipped, fell, and broke his wrist because the defendants had negligently designed and constructed the bathroom area of the prison, creating a hazardous condition that was a cause of his injury. He contends the condition had previously caused similar injuries...
