I. INTRODUCTION

Defendant David Dean Austin was convicted by a jury on one count of possessing stolen mail in violation of 18 U.S.C. § 1708. After his conviction, Austin filed a motion for a new trial and a motion for judgment of acquittal. The district court denied the motions, sentencing Austin to the custody of the Bureau of Prisons for two months and seven days, imposing a thirty-six month term of supervised release, and ordering...
