This action began in 1994 when Dylan W., a minor, was removed from the care of his mother, Raquel W., by the State for reasons irrelevant to this appeal. Raquel was murdered in 1995. On August 20, 1998, Patricia W., Dylan's maternal grandmother, intervened in the Douglas County Separate Juvenile Court seeking custody of Dylan or, in the alternative, visitation with him.
