Presently before the Court is the Defendants' Motion to Dismiss (Doc. No. 11) and Defendants' Motion for Summary Judgment (Doc. No. 28). For the following reasons, the Court finds Defendants' Motion to Dismiss should be granted-in-part and denied-in-part and that Defendants' Motion for Summary Judgment should be granted.
