Irene J. Stevenson brought this action to have set aside a deed by which she conveyed a 16-acre tract of land and accompanying residence ("the property") to the Wake Forest Baptist Church ("the church"). After filing the complaint, but before trial, Ms. Stevenson died and her executor was substituted. For purposes of this opinion, Irene Stevenson will be referred to as plaintiff.
