On March 25, 1999, the defendant was charged by grand jury indictment with second degree murder. La. R.S. 14:30.1. He was arraigned April 1, 1999, and pled not guilty. The defendant waived trial by jury and was found guilty as charged in a bench trial September 22, 1999. He filed a motion for new trial which was denied October 5, 1999.
