GILBERT, Justice.

This matter comes to us as an appeal of right from a conviction of murder in the first degree in Ramsey County District Court. The jury found Alex Chico Tovar (Tovar) guilty of first-degree murder while committing a kidnapping, and other lesserincluded offenses, in the January 31, 1998 killing of Joshua James Christenson (Christenson).
