THIS MATTER is before the Court on Plaintiff's Motion for Summary Judgment (Doc. 28) and Defendant's Motion for Summary Judgment (Doc. 34), both filed January 21, 2000. The Court has reviewed the motions, the memoranda submitted by the parties, and the relevant authorities. The Court finds that Defendants' argument is well taken and rejects Plaintiffs' argument.
