Currently pending before the Court are defendants' Motion to Dismiss Plaintiff's Amended Complaint and plaintiffs Motion for Leave to File a Second Amended Complaint. For the reasons set forth in this memorandum, defendants' Motion to Dismiss Plaintiffs Amended Complaint is granted and plaintiffs Motion for Leave to File a Second Amended Complaint is denied.
