Noah Lawal, a Nigerian citizen who had been in the United States for ten months1 prior to his arrest, was indicted for conspiracy to possess with intent to distribute heroin in violation of 21 U.S.C. § 846 and attempting to possess heroin with the intent to distribute it in violation of 18 U.S.C. § 841(a)(1).
