On April 23, 1995, a fire occurred at the offices of Gardner Trucking, Inc. Thereafter, Ruby Gardner was charged with arson in violation of 18 U.S.C. §§ 844(i) and 2 (Count I), mail fraud in violation of 18 U.S.C. §§ 1341 and 2 (Counts II and III), and using fire to commit a federal felony in violation of 18 U.S.C. § 844(h) (Count IV).
