STATEMENT OF THE CASE

On June 11, 1998 the State filed an indictment charging the defendant with one count of aggravated rape of a victim under the age of twelve, a capital offense. The indictment was assigned docket number 398-849 and allotted to Section "E" of Criminal District Court. The defendant was arraigned and entered a not guilty plea on July 1, 1998.
