The issue before us is whether the Circuit Court for Baltimore County erred in denying petitioner's motion for new trial, based on newly discovered evidence. Petitioner's complaint is not that the motion should have been granted, but that it should not have been denied without a hearing. At our request, she and the State have also addressed the question of whether the court was authorized to act on the motion while her appeal from the judgment of conviction...
