STATEMENT OF THE CASE

This case arose out of an automobile accident which occurred on 14 August 1986. Plaintiff, Maria Benton, was injured in the accident and sued the adverse driver, his insurer and her uninsured motorist insurer. The driver's suit was settled for policy limits and plaintiff accepted an unconditional tender of $40,000 from the UM carrier, reserving her rights to proceed with her suit.
