HOUSTON, Justice.

Doster Construction Company, Inc. ("Doster"), the defendant in an action currently pending in the Jefferson Circuit Court, petitions for a writ of mandamus directing the trial court to grant its motion to compel the deposition of the plaintiff, Curtis O. Childress. We grant the petition in part and issue the writ.
