Victor Hucks was convicted by a jury in the Circuit Court of Arlington County of breaking and entering with intent to commit larceny, in violation of Code § 18.2-91. On appeal, Hucks contends the trial court erred 1) in giving a jury instruction offered by the Commonwealth to which he objected; and 2) in denying his motion to strike the Commonwealth's evidence for failure to prove intent to commit larceny.
