The EPA civilly charged Robert Krilich with illegally filling a wetland on property he was developing in suburban Chicago, Illinois. Krilich entered into a consent decree with the EPA to settle the dispute, the terms of which required him, among other things, to create a substitute wetland by a specific date, or pay a substantial penalty for any delay.
