Defendant, Rickey James, was found guilty of three counts of first degree robbery, violations of LSA-R.S. 14:64.1, after a bench trial. On original appeal, this court found that the trial record did not contain an affirmative waiver by the defendant of his right to trial by jury.1 This court remanded to the trial court for an evidentiary hearing to establish whether defendant in fact made the waiver.
