¶ 1. Michael Naylor ("Naylor") was indicted on May 31, 1995, for the sale of cocaine pursuant to Miss.Code Ann. § 41-29-139 (1993). Because Naylor had been previously convicted of a drug charge, the State sought enhanced sentencing under Miss.Code Ann. § 41-29-147 (1993).
