On January 4, 1999, Defendant, Brian V. Stewart, was charged by bill of information with driving while intoxicated-third offense (DWI-3rd). Following the denial of his motion to quash a prior guilty plea, Defendant, with retained counsel, entered a guilty plea to DWI-3rd, pursuant to State v.
