Defendant was convicted after a jury trial of criminal possession of a controlled substance in the fourth degree (Penal Law § 220.09 [1]) and criminal possession of a controlled substance in the seventh degree (Penal Law § 220.03). We reject the contention of defendant that he was convicted of an unindicted offense. Defendant was indicted and tried for the possession of all the cocaine found in the vehicle...
