The appellant, Samuel Smith, entered a guilty plea to rape in the second degree, in violation of § 13A-6-62, Ala.Code 1975. He was sentenced to 10 years' imprisonment; that sentence was split, and he was ordered to serve three years, concurrently with other cases.
