NATURE OF CASE

This is an action for damages arising from the alleged wrongful rejection of goods. In the first trial, the court granted summary judgment in favor of Stan Smith (Smith) on the issue of liability. Prior to submitting the issue of damages to the jury, the trial court granted a directed verdict in the amount of $28,542.37. We reversed the judgment and remanded the cause for further proceedings.
