The defendant Biliki Brimah was convicted and sentenced on one count of distribution of heroin in violation of 21 U.S.C. § 841(a)(1). The defendant now appeals, arguing that the district court erred in failing to apply the exclusionary rule at sentencing to bar the introduction of evidence that the district court determined was seized in violation of the Fourth Amendment prohibition against unreasonable searches and seizures.
