Bernita Kissinger, the appellee, filed a petition to compel Genetic Evaluation Center, Inc. (GEC), the appellant, to repay the remainder of a $40,000 note she had previously provided to GEC. The note was cosigned by GEC and Bernita's husband, Ralph Kissinger, Jr., who simultaneously gave Bernita a security interest in a house for the note.
