Justice RATHJE delivered the opinion of the court:

Defendant, Ronald R. Alvine, struck and killed a police officer while attempting to steal a car. A jury convicted him of both knowing murder (720 ILCS 5/9-1(a)(2) (West 1998)) and felony murder (720 ILCS 5/9-1(a)(3) (West 1998)). Defendant waived a jury for sentencing, and the trial court sentenced him to death for knowing murder. Defendant was not sentenced on the felony...
