William Garner III was convicted in the Circuit Court of Geneva County, under two separate indictments, for unlawful distribution of a controlled substance, violations of § 13A-12-211, Ala.Code 1975. The two cases were consolidated for trial. Garner stipulated that his unlawful sales occurred within three miles of a school and within three miles of a public housing project owned by a housing authority.
