In August 1997, the State charged defendant Derrick Thurmond, with two counts of criminal sexual assault pursuant to section 12-13(a)(3) of the Criminal Code of 1961 (Criminal Code) (720 ILCS 5/12-13(a)(3) (West 1998)).
