OPINION

JOHNSON, Judge:

¶ 1 James Charles Childress was tried by a jury in the District Court of Sequoyah County, Case No. CF 96-292, before the Honorable John C. Garrett, District Judge. Appellant was found guilty of first degree murder (Count 1), in violation of 21 O.S.Supp.1997, § 701.7, and larceny of a domestic animal (Count 2), in violation of 21 O.S.1991, § 1716.
