Mack Lamar Estes was indicted for rape and sexual abuse in the first degree. A jury convicted Estes of sexual abuse in the first degree, a violation of § 13A-6-66, Ala.Code 1975. He was acquitted on the rape charge.

The trial court originally sentenced Estes to 15 years' imprisonment. The trial court split the sentence, and ordered Estes to serve 3 years' imprisonment and 12 years' supervised probation. However, after a hearing on a motion...
