ORDER DENYING MOTIONS FOR SUMMARY JUDGMENT

KORNMANN, District Judge.

[¶ 1] Defendants filed motions for summary judgment, Docs. 58 and 61. The Court advised the parties during the pre-trial conference on May 10, 1999, that the Court would deny the motions and issue a written opinion at a later date. The Court now denies the motions for summary judgment for the reasons stated herein.
