When Michael J. Krueger filed bankruptcy under Chapter 13 of the Bankruptcy Code, his plan proposed that First National Bank ("the Bank") release its second mortgage on Mr. Krueger's residence. The Bank objected to confirmation of the plan. The bankruptcy court sustained the Bank's objection and, on appeal, the district court affirmed the bankruptcy court's holding that the Bank was not required to release the mortgage.
