Defendant was indicted for rape in the second degree and sodomy in the second degree after having allegedly engaged in sexual acts with an 11-year-old girl (hereinafter the victim). The victim was the daughter of defendant's former girlfriend (hereinafter the mother) and accompanied defendant on a road trip in July 1995.
