ROZIER v. STATE

No. 99-744.

739 So.2d 161 (1999)

Charles ROZIER, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, First District.

August 17, 1999.

Attorney(s) appearing for the Case

Charles Rozier, pro se.

Robert A. Butterworth, Attorney General, Tallahassee, for Appellee.

PER CURIAM.

We affirm the trial court's order denying appellant's belated Florida Rule of Criminal Procedure 3.850 motion, but do so without prejudice to appellant's filing a petition for writ of habeas corpus in the circuit court requesting leave to belatedly file a rule 3.850 motion. See Steele v. Kehoe, 24 Fla. L. Weekly S237, ___ So.2d ___, 1999 WL 343071 (Fla. May 27, 1999).
