HARRIS, J.

Based on the state's concession of error, the decision below is reversed and remanded to the trial court to begin again at the point where the defendant is advised of his right to counsel. The court should determine whether the waiver is freely and intelligently made. Further, defendant should not be sentenced on charges which have been nolle prossed.

REVERSED and REMANDED.
