The State appeals the suppression of statements by Dusty Waldrop relating to his arrest for the offense of driving while intoxicated (DWI). See Tex. Penal Code Ann. § 49.04 (West 1994). At pre-trial conference, the trial court ordered the suppression of Waldrop's statements regarding where he had been, how much he had been drinking, and whether he was drunk.
