Defendant-appellant, Robert J. Caulley, appeals the judgment of the Franklin County Court of Common Pleas denying his motions for appointment of appellate counsel and preparation of a trial transcript at state expense. We find that the trial court abused its discretion in applying the standard for determining whether a criminal defendant is entitled to court-appointed counsel as set forth in State v. Tymcio, (1975),
