By grand jury indictment dated January 25, 1996, defendant was charged with one count of second degree murder; and, he pleaded not guilty. On May 5-7, 1997, a twelve-member jury that found the defendant guilty as charged. On May 21, 1997, the trial court denied defendant's motion for new trial and sentenced him to life imprisonment at hard labor without benefit of parole, probation, or suspension of
