MEMORANDUM OPINION AND ORDER

ALESIA, District Judge.

Before the court is respondent the Immigration and Naturalization Service's motion to dismiss the petition for writ of habeas corpus and "to revoke the bond set on December 17, 1998" pursuant to Federal Rule of Civil Procedure 12(b)(1). For the reasons that follow, the court grants respondent's motion to dismiss and to revoke the bond.
