CARTER, C.J.

The defendant, Clemone W. Lanieu, was charged by grand jury indictment with second degree murder, a violation of LSA-R.S. 14:30.1. He pled not guilty and, after trial by jury, was found guilty of the responsive verdict of manslaughter, a violation of LSA-R.S. 14:31. He subsequently was sentenced to forty years at hard labor. He has appealed, urging five assignments of error.
